These Terms of Use and Conditions govern your use of our website at (www.upbeetnutritiondietetics.com.au) and services. By accessing or using our website and services, you agree to comply with these Terms and Conditions.

Your use of our website and the information available is referred to in these Terms of Use as ‘Online Services’. Please read them carefully before proceeding.
The Online Services are published by Upbeet Nutrition and Dietetics.
These Terms of Use apply to:

  1. the use of the Online Services

  2. access to the Online Services from third party websites

  3. the content or material contained in the Online Services, accessed via links from the Online Services or that we provide via email or mobile, including health information, publications, fact sheets and updates (Information).

  4. The services provided by us via telehealth, face to face or online.

In these Terms of Use, ‘Upbeet Nutrition and Dietetics’, ‘we’, ‘us’ ‘Provider’, ‘therapist’ and ‘our’ refers to Upbeet Nutrition and Dietetics ABN 83 561 070 852 as the licensed owner of the Online Services, and the terms ‘you’ and ‘your’ refer to the client, user or viewer of the Online Services or the user of Information.

Service Agreement Contract

By confirming and attending an appointment with Upbeet Nutrition & Dietetics, you acknowledge and agree to the terms and conditions outlined in the service agreement below. This agreement is designed to ensure clarity and mutual understanding of the services provided, your responsibilities as a client, and the expectations of both parties. Your participation in any scheduled appointments signifies your acceptance of these terms, as well as your commitment to engaging in a professional and respectful partnership focused on achieving your nutritional goals.

2. Service Type

Nutrition & Dietetics
The Provider agrees to provide the client Nutrition & Dietetics services for the duration of the agreement at the scheduled rate. These may include:

  • Nutrition & Dietetic assessment, intervention, education and treatment

  • Clinically relevant communications, including phone calls/written programs/communication with other health professionals (any task that takes more than 15 minutes will be invoiced)

  • Attendance at team meetings/case conferences

  • Assessment and trial of equipment/devices as required

  • Mealtime and communication management plans

  • Any reports, forms, or letters as required

  • Cancellation charges for late notice or no-show appointments

3. What Supports Will Be Provided?

How they will be provided:
Dietetics services may include one-on-one intervention, group therapy either face-to-face or via telehealth sessions within a clinic, school, community (aged care facility or group home), or home setting. You and your dietitian will discuss the best way therapy will be provided to you according to your individual needs.

When they will be provided:
Upbeet Nutrition & Dietetics provides services year-round. You and your dietitian will decide upon suitable dates/times. Therapy does not continue on public holidays, and as a result, you will not be billed for the session. You will be advised of annual leave in advance, and any unexpected leave due to sickness and/or other personal reasons will be communicated to you in a timely manner by your dietitian.

Who will provide them:
Rachel Fletcher, Accredited Practising Dietitian, Principal Dietitian, Upbeet Nutrition and Dietetics.

How long they will be provided for:
Services will cease once advised by the client. Services will continue as arranged unless otherwise specified by the client or provider.

4. Client Expectations

  • Communicate the supports that you want and how you want to receive them (e.g., face-to-face sessions, telehealth, frequency of follow up).

  • Be polite and respectful to the therapist and administration support you work with.

  • Inform the therapist if you have any concerns or problems.

  • Provide enough notice for appointment cancellations. It is recommended to provide 24 hours’ notice unless due to sickness or other unforeseen circumstances.

  • Inform the treating therapist if you wish to cease the service agreement.

  • Arrive at your scheduled appointment on time or phone in advance if you may be late to an appointment.

  • Disclaimer: The services provided by Upbeet Nutrition & Dietetics are designed to offer expert guidance and support; however, no guarantee of specific outcomes can be made. The responsibility for implementing the suggested advice and achieving the desired results rests entirely with the client. Consistent effort and adherence to the recommended plan are essential for optimal outcomes, and individual results may vary based on a range of factors.

5. Service Provider Expectations

  • The therapist will provide the services you have requested and agreed upon in the initial consultation.

  • The therapist will be honest and open at all times regarding intervention choices and results obtained.

  • The therapist will explain things as clearly as possible and will provide additional information through pamphlets and research where suitable.

  • The therapist will treat you politely and with respect.

  • The therapist will include you in all decisions about intervention and will work specifically with your goals.

  • The therapist will maintain client confidentiality and will store all information carefully to ensure it is kept private.

  • The therapist will obey all applicable rules and laws regarding service delivery.

  • The therapist will provide invoices and statements for all consultations.

  • The therapist and the client will discuss and review the service agreement regularly.

6. Payment Details

Upbeet Nutrition & Dietetics will seek payment for their provision of supports after the supports have been delivered.

  • Payment Terms: The client / client representative will receive an invoice for the supports provided.

  • It is expected that all fees are paid either at the end of consultation or within 7 business days. We accept cash (exact amounts), online transactions via tyrohealth or stripe, and bank transfers (pending approval of the clinician).

  • If you have a Medicare Management plan or private health insurance, please ensure your clinician has this information BEFORE your appointment to ensure appropriate processes are followed to allow you to submit a claim for rebates following your appointment.

7. How to Make Changes

Any changes to the service agreement will be discussed or written and signed by both the client and the therapist. Both parties will agree on any changes made.

8. How to End a Service Agreement

If you wish to end the service agreement, you must advise the therapist at least 24hr prior to upcoming appointments

Service agreements can end if the client or the service provider breaches any of the above-listed expectations.

9. What to Do if There Is a Problem?

If you have a problem with the service agreement or with the intervention plan, please speak directly to your treating therapist.

10. Goods and Services Tax (GST)

Most services provided by Upbeet Nutrition & Dietetics are GST-exempt. However, GST may apply to some services (e.g., reports). It is the service provider's responsibility to check whether GST applies.

11. Cancellation Policy

At Upbeet Nutrition & Dietetics, we value consistent and high-quality intervention. If you need to cancel an appointment, it is recommended that you do so 24 hours prior to your appointment where possible, unless due to sickness or other unforeseen circumstances.

Rescheduling Appointments

No fees are charged if more than 24hrs notice is provided for cancellations or rescheduling appointments. Please contact us as early as convenient to reschedule any appointments

If you are unable to attend your scheduled appointment, the practice will, when able, provide you with an alternative appointment time on your scheduled day of service, so as to avoid a cancellation fee being charged.

Late & Missed Appointments

Clients arriving late to an appointment, but within their appointed time slot, may receive a shorter consultation in an effort not to inconvenience other client's waiting.
Clients who either arrive late, or miss an entire appointment, will be charged the full consultation fee.

Cancellations within 24hrs

If you contact Upbeet Nutrition & Dietetics within 24 hours of your appointment or on the day of your appointment, there will be a cancellation fee of 90% charged to your account and payment due at your next appointment.

Fail-to-attend appointments

For any fail-to-attend appointments with no cancellation notice, 100% of your scheduled fee for that session will be applied. This will be charged to your account and payment due at your next appointment.

Provider Cancellations

Where Upbeet Nutrition & Dietetics cancels a support due to operational reasons, the service will be rescheduled at no penalty to either party. The provider will make every effort to give adequate notice should an appointment need to be canceled, ensuring minimal disruption to your care.

Upbeet Nutrition & Dietetics reserves the right not to provide service or to cancel any future appointments for the client if payment terms are not met.

Use of Website/ Online Services

You may use our Online Services for lawful purposes and in accordance with these Terms and Conditions. You agree not to:

  • Use our Online Services in any way that violates applicable laws or regulations.

  • Interfere with or disrupt the operation of our Online Services or provision of physical services.

  • Engage in any activity that could damage, disable, or impair our Online Services or provision of physical services.

  • Attempt to gain unauthorized access to any part of our Online Services or provision of physical services.

Important information

The Information contained in, or accessed through, the Online Services is for your general information and use only and is not a substitute for independent professional advice from an Accredited Practising Dietitian (APD). You should not disregard professional advice, or delay seeking it, because of any Information contained on the Online Services. You should consult with your APD or medical practitioner before acting on any of the Information presented.

The information provided on this website is for educational purposes only and is not intended to replace or constitute individualized medical, nutritional, or professional advice. Always consult with a qualified healthcare provider or dietitian for personalized recommendations and guidance tailored to your specific needs and circumstances.

Indemnification

You agree to indemnify and hold harmless Upbeet Nutrition and Dietetics, its directors, employees, and affiliates from any claims, damages, liabilities, costs, or expenses arising out of your use of our Online Services or services, or your violation of these Terms and Conditions.

Disclaimer of warranties

While the Information is subject to Upbeet Nutrition and Dietetics’ quality assurances processes, the Information is also subject to continuing research, clinical experience, reasonable differences in opinions among authorities, unique aspects of individual situations and the possibility of human error in preparing the Information. No representation or warranty (express or implied) is made as to the currency, completeness, accuracy, reliability, suitability, and/or availability of the Information. In addition, no representation or warranty (express or implied) is made that the Information will meet your health or medical requirements.

Whilst we provide general health information, the circumstances of each individual will differ. You should exercise your own judgment with respect to your use of our Online Services and Information and you should carefully evaluate the currency, completeness, accuracy, reliability, suitability and relevance of the available information. System requirements

Some services available through the Online Services will require your computer, telephone, internet access, device and associated equipment to meet certain technical levels (System Requirements) in order to receive the services. Upbeet Nutrition and Dietetics takes no responsibility for problems associated with or arising from your inability to access or receive the services due to your equipment or internet speed not meeting the System Requirements.

Deemed acceptance
